In this Agreement, the expressions "we", "us" and "our" are a reference to JungleTANGO and the expressions "you" and "your" are a reference to the JungleTANGO Website User or people who agree to the Terms of Access. "Credits" means the prepaid purchase amount you have already purchased. "the Site", "this Site" & "our Site" are references to web site located at www.jungletango.com. "Buyer" or "Purchaser" means any person capable of purchasing credits on this Site. "Seller", "Merchant" and "Member" means a person or a person on behalf of an entity that has agreed to the terms and conditions of the Membership Agreement and are persons who use the membership section of the Site and have a status of Merchant. "Theme", "Themes" are references to the files prepared by Merchants, either for upload or download on the Site together with any accompanying material such as Theme description, and the associated Intellectual Property rights.

The Agreement

• These terms and conditions in this Agreement ("the Agreement") apply to the use of this Site. When using this Site, you agree to be bound by this Agreement.
• If you do not accept the terms and conditions in this Agreement, you must refrain from using the Site immediately.
• The Agreement must be used and accepted in conjunction with the Privacy Policy and Membership Agreement or any other applicable terms and conditions governing the use of the Site.
• Your age must be at least 18 years or over. If you are under 18 years of age you are not allowed to register.

You must agree to our role

• Our Site acts as a trading platform between buyers and sellers and thus we are not involved in any transaction between these two parties using our Site.
• We cannot ensure and do not guarantee that a buyer or seller will actually complete a transaction or act lawfully in using our Site.
• We have no control and are not responsible for the truth or accuracy of the Themes, Theme descriptions or content uploaded by merchants on this Site.
• We have no control and are not responsible for the quality, safety or legality of the Themes or Theme description uploaded by Merchants on this Site.
• We make no warranty that Themes or services acquired from us over this Site will meet your requirements.
• Despite all reasonable precautions on our Site, there is a risk of unauthorised access to or alteration of your transmissions or data or of information contained on your computer system or on this Site. We do not accept responsibility or liability of any nature for any such losses which you may sustain as a result of such activity.
• We do not accept responsibility for loss suffered as a result of reliance by you upon the accuracy or currency of information contained on this Site.

You agree to release us from liability

In the event that you have a dispute or breach of agreement with one or more members, you release us from claims, demands and damages of every kind and nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with such disputes or breaches.

You agree to indemnify us

You agree to indemnify and hold us harmless from and against any claims, damages, proceedings, losses and damages of very kind and nature, including solicitors’ fees, made by any third party due to or arising out of your breach of this Agreement or the terms and policies it incorporates by reference, or our violation of any laws or the rights of third parties.

Disclaimer

We do not accept responsibility for any loss damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of this Site or any linked website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this Site.

We will not accept liability to you in respect of any loss or damage (including indirect, special, or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of Themes or services supplied pursuant to an order placed on this Site or in respect of any failure or omission on our part to comply with our obligations as set out in this Agreement.

Copyright and Trade Marks

Copyright in this Site (including Themes) is owned or licensed by us or by our members. You may not in any form or by any means commercialise any information or services obtained from any part of this Site without our written permission.

Except where otherwise specified, any word or device to which is attached the TM or R symbol is a registered trade mark.

You must not use any of the trade marks displayed on the Site:

• In or as the whole or part of your own trade marks or trade marks visible on the Site
• In connection with activities, products or services which are not ours
• In a manner which may be confusing, misleading or deceptive
• In a manner that disparages us or our information or services (including this Site)

Security of information

Any information which you transmit to us is transmitted at your own risk. No data transmission over the Internet can be guaranteed as totally secure. We have taken precautions to protect your information but we also do not warrant and cannot ensure the security of any information which you transmit to us.

Termination of Access

Access to this Site may be terminated at any time by us without notice!
